Long-Awaited Articles of Impeachment Against DHS Secretary Mayorkas Arrive in Senate

The House delivered the two articles of impeachment againstΒ Homeland Security Secretary Alejandro Mayorkas to the Senate on Tuesday afternoon.

The articles are expected to beΒ acted on quickly by the Democrat-controlled Senate, but not in the manner House GOP lawmakersΒ are seeking. Β 

β€œWe want to address this issue as expeditiously as possible,” Senate Majority Leader Chuck Schumer, D-N.Y., said during a floor speech Monday discussing the articles of impeachment. Β 

Republicans who backed the impeachment of Mayorkas are concerned that Schumer will hold a vote to dismiss the articles of impeachment altogether. Dismissal only requires a simple majority, which is not out of the question, given Democrats’ control of the upper chamber. Β 

Schumer also hasΒ the option to refer the articles to committee, where they would likelyΒ die, or to hold a full Senate trial, which Schumer is not expected to do, given his own vocal opposition to Mayorkas’ impeachment. Β 

β€œImpeachment should never be used to settle a policy disagreement,” Schumer said, adding, β€œThat would set a horrible precedent for the Congress.” Β 

House and Senate Republicans supporting impeachment have maintained a pressure campaign on Schumer to force a Senate trial. Β 

β€œUnder the Constitution, the responsibility of the Senate is simple and straightforward: The Senate must hold a trial,” said Sen. Ted Cruz, R-Texas. Β 

β€œChuck Schumer doesn’t want to do that,” Cruz added. β€œInstead, he wants to move to table the entire thing for three reasons. First, he does not want to allow the House managers to present evidence of Mayorkas’ willful decision to aid and abet the criminal invasion of this country. Second, he does not want the American people to see the facts. Third, he does not want Senate Democrats on the ballot in November to have to vote β€˜not guilty’ because the evidence is indisputableβ€”Alejandro Mayorkas is guilty.” Β 

Rep. Mark Green, R-Tenn., serves as chairman of the House Homeland Security Committee and led the impeachment effort against Mayorkas. Β

The Republican-controlled House votedΒ 214 to 213 on a party-line vote to impeach Mayorkas on Feb. 13 after a failed attempt a week prior.Β Β 

The House’s first article alleges that the homeland security secretaryΒ has failedΒ to secure America’s border and enforce immigration laws, and instead has executed policies that incentivize illegal immigration.Β Β Β Β 

The House’s second article of impeachment contends that Mayorkas is in breach of the public trust and knowingly has madeΒ false statements to CongressΒ and the American people.Β 

Like his conservative colleagues in the House, Cruz says Mayorkas bears much of the responsibility for the record high number of encounters of illegal aliens at America’s borders. Β 

β€œMayorkas has aided and abetted the criminal invasion of the United States,” Cruz said. β€œThis is a humanitarian, public safety, and national security crisis.” Β 

Schumer told his fellow senators in a β€œDear Colleague” letter on April 5 that when the articles of impeachment arrive in the Senate,Β senators will be sworn in as jurors the following day and that Senate President Pro Tempore Patty Murray, D-Wash., will preside over the chamber. Β 

The House was originally going to deliver the two articles of impeachment to the Senate on April 10, but Johnson delayed the delivery after a group of GOP senators asked him to do so to allow more time for debate on the Senate floor before the weekend.

Schumer said Monday that his plan of action in the Senate has not changed despite the arrival of the articles being delayed six days. Β

β€˜Why Are You Filibustering?’: Mayorkas Stumbles Over Answer When Asked What Powers He Lacks to Enforce Border

Rep. Michael Cloud, R-Texas, left Secretary of Homeland Security Alejandro Mayorkas stumbling during a Wednesday hearing by rhetorically asking him what powers Congress had stripped him of to enforce the border.

Mayorkas testified during aΒ hearingΒ of the House Appropriations’ homeland security subcommittee titled β€œBudget Hearing: Fiscal Year 2025 Request for the Department of Homeland Security.” Cloud questioned Mayorkas about whether he lacked the power and authorization to secure the U.S.-Mexico border due to congressional action since he took office.

β€œCould you speak to any authorities that Congress has removed from you or the president since taking office?” Cloud asked Mayorkas, in reference to claims by President Joe Biden that he is unsure whether he has the power to take certain steps to prevent illegal immigration. Biden said he was β€œexamining” what powers he had to close the border during a UnivisionΒ interviewΒ that aired Tuesday.

β€œHas Congress removed any authorities from you or the president since taking office?” Cloud asked as Mayorkas stammered in response.

β€œThat is a β€˜yes’ or β€˜no’ question,” Cloud added. β€œWhy are you filibustering? I asked you a β€˜yes’ or β€˜no’ question.”

BidenΒ reversedΒ numerousΒ policiesΒ initiated by his predecessor, former President Donald Trump, during his first days in office. Mayorkas has claimed that the border is secure onΒ severalΒ occasions, despite U.S. Customs and Border Protection reportingΒ more than 6.6 million encounters with illegal immigrants since the start of fiscal year 2021.

β€œYou have approximately a 20% larger budget than Trump had,” Cloud said. β€œThe president has made the point that he can’t secure the border, he can’t get down to it, because he is waiting on Congress to move, and I just point that out to belay that and to point out the truth, the fact that he has every single authority as President Trump, he has more resources at his disposal than President Trump, yet he’s done everything he can to undermine the security of our border.”

Senator Vows to Go Down β€˜Screaming and Fighting’ in Mayorkas Impeachment Battle

Two months ago, the House voted to impeach Homeland Security Secretary Alejandro Mayorkas. Next week, the Senate will receive the two articles of impeachment against Mayorkas, but Senate Majority Leader Chuck Schumer, D-N.Y., is expected to dismiss the charges just as quickly as he receives them.Β 

β€œSchumer is going to table it,” Sen. Roger Marshall, R-Kan., predicts of the impeachment articles.

The articles were originally expected to be delivered to the Senate on Wednesday, but some Senate Republicans asked House Speaker Mike Johnson, R-La., to delay the delivery until next week. Fox News reported that the benefit of delaying the delivery of the articles is to allows more time for debate without the time restraint of the coming weekend.

Schumer has not indicated he plans to change his position on the articles of impeachment if they arrive next week instead of Wednesday.

If Schumer does dismisses the charges against Mayorkas, it will be a historic first, according to Marshall.Β 

β€œThis has never happened before,” the Kansas lawmaker said, adding that there have β€œbeen 21 impeachment trials over on the House side. Four of those, the person died [or] they resigned, but 17 of them still had the person in office when those impeachment articles were delivered, and every one of those was followed through with the trial. Again, this is so toxic that Chuck Schumer is going to table it. That’s certainly what it looks like, but we’re going to go down screaming and fighting,” Marshall says.

Biden Is Ignoring Intelligence Agencies and DHS Reports

White Christians Not a Threat, Border Not Secure

DHS Secretary Alejandro Mayorkas claims, β€œThe border is secure,” and President Joe Biden said, β€œThe most dangerous terrorist threat to our homeland is white supremacy.” Not only are they both lying, but they are also ignoring the reports produced by the US Intelligence Community, including the Department of Homeland Security (DHS) and the Department of Defense (DoD).

Biden appointees, including the president himself, have claimed that the border is secure and that white Christian nationalists are the greatest threats to national security. These statements weaken our ability to address real threats. If the border is secure, then funding for additional security would be unjustified. And if Biden starts wasting public funds and security resources to hunt down white Christians, he will be leaving the country open to attacks from the real threats: China, Russia, North Korea, Iran, and Islamic extremists.

President Trump said he would deport illegal aliens. Kamala Harris went on TV and said that she would β€œfight for their rights.” This statement presumes that illegal aliens have a right to stay in the United States. DHS Secretary Alejandro Mayorkas actually said, β€œFrom day one, this Administration has made clear that a border wall is not the answer.” And certainly, no wall is needed if you do not wish to keep people out.

While the Biden White House and many of his appointees are misrepresenting reality, the intelligence agencies, Department of Defense (DoD), and Department of Homeland Security (DHS), apart from Mayorkas, are doing their duty by identifying the real threats. The Annual Threat Assessment of the United States Intelligence Community identifies the greatest national security threats as China, Russia, Iran, and North Korea. The term β€œwhite supremacy” is mentioned only once, on page 30. By contrast, the word China appears 91 times and has its own entry in the table of contents. White Supremacy is listed as one of many racially or ethnically motivated violent extremists (RMVE). The report does not say that it is a primary threat. In fact, it reports that, across the entire globe, only 27 people, most of whom were not American, were killed by RMVE since 2022.

The Department of Defense (DoD) National Defense Strategy Report similarly recognizes China and Russia as the two largest threats, followed by North Korea and Iran. The report does not mention white supremacy at all.

The Department of Homeland Security (DHS) recognizes terrorism, both foreign and domestic, as the primary threat. This includes radicalization by foreign entities and the rebuilding of al-Qa’ida and ISIS. After terrorism, DHS expects β€œillegal drugs produced in Mexico and sold in the United States will continue to kill more Americans than any other threat.” Last year, there was a record number of encounters with migrants at the southern border, including β€œa growing number of individuals in the Terrorist Screening Data Set (TSDS), also known as the β€˜watchlist.'”

This brings us to the false claim that the border is secure.

Trump was attacked for allegedly saying that migrants are not human. What he was actually saying was that with open borders, we are allowing gang members to enter the country, and the gang members have committed such atrocities that they are not human. He was also attacked for saying that Mexico is not sending us their best and their brightest; they are sending us drug dealers and rapists. He did not claim that all migrants were criminals. He said that some were good people. But he was 100% correct in saying that some are gang members, drug dealers, and criminals.

The US permits about 770,000 immigrants to be naturalized each year, which is more than the rest of the world combined. By definition, those who do not qualify to be admitted legally are not the best and the brightest. Trump’s claims are not only supported by logic but also by the reports of U.S. authorities, including DHS, the Intelligence Community, local media along the border, and The Office of Justice Programs, among others.

FBI Director Wray confirmed that the border crisis is a national security threat. The DEA reported that β€œFentanyl is the greatest threat facing Americans today.” Fentanyl is manufactured in Mexico by cartels, using chemicals from China. It is then smuggled over the border by illegal aliens and distributed through street gangs with ties to the cartel. Often, these gangs have members who are illegal aliens and have been trafficked to the United States to work in illicit businesses such as drug dealing, prostitution, and even murder.

The Annual Threat Assessment of the United States Intelligence Community states that Mexico-based Transnational Crime Organizations (TCOs) β€œare the dominant producers and suppliers of illicit drugs to the U.S. market, including fentanyl, heroin, methamphetamine, and South American-sourced cocaine.”

The Office of Justice Programs issued a report outlining the danger posed by cross-border gangs operating through the southern border. U.S. Immigration and Customs Enforcement wrote, β€œTransnational criminal street gangs such as MS-13 represent a significant threat to public safety.” A report by the Air Command and Staff College Air University stated, β€œMexican Cartels along our Southern border pose a serious threat to our national safety and public health.” Furthermore, the report explained why the cartel threat is increasing: β€œAs their influence and sophistication grow and the connection between them and terrorist organizations increases, the cartels become a larger threat to our national security.”

In conclusion, apart from Biden, neither the intelligence community, DEA, DHS, FBI, ICE, nor the DoD identified white supremacists as the greatest threat to national security. Additionally, no one other than Mayorkas claimed that the border was secure. By ignoring the reports of our intelligence and security agencies, the administration is increasing the threat to our national security.
