House Democrats released an agenda Thursday that includes a vow to codify a right to so-called gender-affirming care—transgender surgeries, hormones, and puberty blockers.
The promise came within the Congressional Progressive Caucus’ agenda, which House Democrats first shared with NBC News. That agenda includes a slew of left-wing interests, including promises of a higher minimum wage and stronger antitrust laws.
“If the progressive base is not excited and enthusiastic—and if they don’t feel like we are trying to earn their votes and that they are important—then I think the horrific idea of a second Donald Trump presidency could become reality,” Rep. Pramila Jayapal, D-Wash., who chairs the progressive caucus, told NBC News in an interview. “We cannot afford to let that happen. And we won’t.”
Although NBC claims that the agenda goes “lighter on cultural issues,” under the category “advancing justice,” it promises to “codify the rights of transgender, nonbinary and intersex people, including gender-affirming care and health care.”
Jayapal did not respond to requests for comment for this article explaining what, exactly, codifying a right to “gender-affirming care” would entail.
In March 2023, she joined with other Democrats in introducing a “Trans Bill of Rights,” citing the rise in parental rights laws, laws protecting kids from gender transitions, and laws prohibiting boys from participating in girls and women’s sports.
“Day after day, we see a constant onslaught of anti-trans rhetoric and legislation coming from elected officials. Today, we say enough is enough,” Jayapal said at the time. “Our Trans Bill of Rights says clearly to the trans community across the country that we see you, and we will stand with you, to ensure you are protected and given the dignity and respect that every person should have.”
That legislation would amend the Civil Rights Act of 1964 to include gender identity as “protected characteristics.” It would also amend federal education laws to say that they protect kids from being discriminated against based on gender identity.
The Trans Bill of Rights also called for ensuring that “every child has the right to grow up in a supportive environment by having their authentic identity respected in the classroom, ensuring they can participate in school sports with their peers, and ensuring access to an inclusive curriculum.”
It further called for “expanding access” to trans surgeries, hormones, and puberty blockers and codifying rights to abortion and contraception.
Jayapal told NBC News that progressive Democrats assume “this is an agenda for a Democratic president with a Democratic Senate and a Democratic House.”
She added: “We have to excite our base. We have to show them what the path forward is—not just say, ‘This is the most important election of your life, and we expect you to vote.’ I don’t think that’s going to turn people out. And so, I think this agenda, really, speaks to the needs of poor people, working people, progressives across the country who want us to make that case to them.”
“We are not seeing the momentum that we would like to see,” she told NBC. We’re going to have a tough election. … We know we’re going to have to put together that progressive coalition. And I think this is the thing that allows us to say, “‘Look, here’s what we’re fighting for.’”

Progressives are using legal loopholes and the power of the federal government to maximize Democrat votes in the 2024 election at taxpayers’ expense, RealClearInvestigations has found.
The methods include voter registration and mobilization campaigns by ostensibly nonpartisan charities that target Democrats using demographic data as proxies, and the Biden administration’s unprecedented demand that every federal agency “consider ways to expand citizens’ opportunities to register to vote and to obtain information about, and participate in, the electoral process.”
A dizzying array of overwhelmingly “democracy-focused” entities with ties to the Democratic Party operating as charities and funded with hundreds of millions of dollars from major liberal “dark money” vehicles are engaged in a sprawling campaign to register the voters, deliver them the ballots, and figuratively and sometimes literally harvest the votes necessary to defeat Donald Trump.
These efforts, now buttressed by the federal government, amplify and extend what Time magazine described as a “well-funded cabal of powerful people ranging across industries and ideologies,” who had worked behind the scenes in 2020 “to influence perceptions, change rules and laws, steer media coverage and control the flow of information” to defeat Trump and other Republicans. The “shadow campaigners,” Time declared, “were not rigging the election; they were fortifying it.”
Heading into 2024, “there is not a ‘shadow’ campaign,” said Mike Howell, executive director of The Heritage Foundation’s Oversight Project. “There is an overt assault on President Trump and those who wish to vote for him occurring at every level of government and with the support of all major institutions.” (The Daily Signal is the news organization of The Heritage Foundation.)
By contrast, Republican Party stalwarts lament that no comparable effort exists on their side. The GOP’s turnout and messaging efforts seek to thread a difficult needle by encouraging early and absentee voting and ballot-harvesting—pandemic-era measures that Trump and supporters blame for his 2020 electoral defeat—while the party simultaneously fights the mainly blue-state laws that made the practices possible. The party’s position is further complicated by its standard-bearer’s warnings of a rigged election bigger than in 2020, which some speculate could turn off moderate swing voters.
The IRS permits tax-exempt nonprofit groups to engage in voter registration and get-out-the-vote drives so long as they do not “refer to any candidate or political party” nor conduct their activities “in a biased manner that favors (or opposes) one or more candidates prohibited.”
These entities have become magnets for funds not only from wealthy donors, who can contribute without traditional campaign finance limits—and get a tax break to boot—but also abundantly endowed private foundations that are prohibited from engaging in partisan activities.
In recent years, dozens of progressive-oriented 501(c)(3)s, now pulling in upward of $500 million annually, have engaged in purportedly neutral efforts to impact elections, according to Hayden Ludwig, director of policy research at the election integrity-focused advocacy group Restoration of America.
In practice, critics like Ludwig argue, left-leaning charities flout the law by registering and mobilizing demographics that tend to vote disproportionately Democratic behind a veil of nonpartisan democracy promotion.
During the 2020 election, for example, the Voter Participation Center solicited millions of ballot applications in swing states—many of them prefilled for respondents. This nonprofit, like its peers, is clear that it isn’t targeting just any voters, but what it and progressive activists have dubbed a “New American Majority” of “young people, people of color and unmarried women.”
Tom Lopach, a longtime Democratic Party operative and the center’s president and CEO, told RealClearInvestigations in a statement: “We do the work that state election officials typically do not do—seeking out underrepresented voting-eligible Americans … This is difficult but necessary work that brings democracy to eligible Americans’ doorsteps.”
In 2020, Facebook founder Mark Zuckerberg and his wife Priscilla Chan showed how supposedly neutral efforts can have a partisan impact when they funneled some $400 million through two progressive–led but purportedly nonpartisan nonprofits into election offices across the country.
That money disproportionately went to jurisdictions that Joe Biden won in the pivotal battleground states that delivered his victory, often flowing to left-leaning nonprofits to whom election offices outsourced the administration of sometimes critical functions.
In April 2022, a primary conduit of these so-called Zuckerbucks, the Center for Tech and Civic Life, announced the launch of a successor to the 2020 effort—the U.S. Alliance for Election Excellence, a five-year $80 million program “to envision, support, and celebrate excellence in U.S. election administration.”
“The left has assembled an impressive ‘election-industrial’ complex of nonprofit organizations that is constantly working towards goals like ‘promoting participation’ targeting ‘underrepresented minorities,’” said Jason Snead, executive director of the conservative Honest Elections Project. Such terms, Snead says, “are code for identifying and mobilizing liberal voters.”
Election experts view such activities as potentially decisive.
“‘Nonpartisan’ and ‘charitable’ voter registration and get-out-the-vote groups” are the Democratic Party’s “electioneering super-weapon[s],” said Parker Thayer, an analyst with the conservative-oriented Capital Research Center in Washington, D.C.
Of these, Thayer sees the Everybody Votes Campaign as of paramount importance.
Born of a plan “commissioned by [Hillary] Clinton campaign chairman John Podesta, funded by the Democratic Party’s biggest donors, and coordinated with cut-throat Democratic consultants,” Thayer writes in an extensive analysis of the group’s efforts, “the Everybody Votes campaign [has] used the guise of civic-minded charity to selectively register millions of ‘non-white’ swing-state voters in the hopes of getting out the Democratic vote.”
It does so by funding and training over 50 community groups to register voters to close “the voter registration gap in communities of color,” which it attributes to “modern forms of Jim Crow laws,” such as voter ID requirements, the group’s executive director, Nellie Sires, said in a January 2024 interview.
From 2016-2021, the Everybody Votes Campaign, doing business as three entities, collected over $190 million from major Democratic Party donors, unions, and environmental activists. Some of the largest donors include the League of Conservation Voters Education Fund; the New Venture and Hopewell funds, managed by for-profit consulting firm Arabella Advisors; and the George Soros-funded Foundation to Promote Open Society—all 501(c)(3) public charities or private foundations forbidden from supporting “voter education or registration activities with evidence of bias.”
The Everybody Votes Campaign distributed the funds to a slew of left-leaning state-based voter registration organizations largely in eight pivotal states from 2016 to 2019—Arizona, Colorado, Florida, Georgia, Ohio, North Carolina, Virginia, and Nevada—and then to Pennsylvania, Michigan, and Wisconsin in 2021.
According to Thayer’s analysis, the Everybody Votes Campaign’s voter registration push “would have provided Democrats more votes than the total margins of victory in Arizona, Georgia, Nevada, and Pennsylvania,” securing Biden’s victory in the 2020 election.
One notable backer of the Everybody Votes Campaign is Mind the Gap, a “Moneyball-style” Silicon Valley Democratic super PAC founded by Stanford law professor Barbara Fried, and connected to the political activities of her convicted crypto-fraudster son, Sam Bankman-Fried.
The analytics-focused outfit prepared a confidential strategy memo leaked in advance of the 2020 election, noting that “501(c)(3) voter registration focused on underrepresented groups in the electorate” would be the “single most effective tactic for ensuring Democratic victories”—“4 to 10 times more cost-effective” on after-tax basis at “garnering additional Democratic votes” relative to alternatives like “broadcast media and digital buys.”
Mind the Gap recommended that donors contribute to three organizations: the Voter Participation Center and its sister organization, the Center for Voter Information for mail-based registration efforts, and Everybody Votes for site-based registration efforts.
The largest grant recipient, receiving $24 million during the 2016-2021 period, was State Voices, which describes itself as a “nonpartisan network of 25 state-based coalitions … that collectively partner with over 1,200 organizations” consisting of “advocates, organizers, and activists … work[ing] together to fight for a healthy democracy and political power for Black, Indigenous, Latinx, Asian American and Pacific Islander (AAPI), and all people of color (BIPOC).”
Another top recipient, raking in over $10 million, was the Voter Participation Center.
According to the Capital Research Center, the Everybody Votes Campaign would collect and spend over $50 million in connection with the 2022 midterm elections—the most recent period for which financials are available. All told, since its founding in 2015, the campaign says, its network has registered 5.1 million voters, of whom 76% are people of color; 56% are women; and 47% are under the age of 35.
Last November, the news outlet Puck reported on a secret memo circulated by Mind the Gap regarding its plans for 2024. “Our strategy early in the 2024 presidential race will be to massively scale high-performing voter registration and mobilization programs,” the memo read. The PAC again specifically directed donors to the Everybody Votes Campaign, which did not respond to requests for comment.
Lopach, who has worked in Democratic Party politics his entire career, bristled at RealClearInvestigations’ questions regarding critics’ claims of a partisan bent to its work. “The presumptions baked into the questions … emailed to us are inaccurate and reveal the reporter’s own biases,” he responded, while emphasizing the organization’s targeting of “underrepresented voting-eligible Americans.”
Thayer has dubbed Everybody Votes the “largest and most corrupt ‘charitable’ voter registration drive in American history.”
Of such organizations’ claims of nonpartisanship, Howell told RealClearInvestigations: “If they were truly interested in an informed participatory constitutional Republic, they would have an even-handed approach to registering voters.”
“Call me when they show up to a NASCAR race, Daughters of the American Revolution event, or a gun show,” Howell added. “Then we can pretend for a minute that these are beyond just facial efforts to appear somewhat neutral.”
But NASCAR races have not been hubs for GOP-led voter registration efforts either. Restoration of America’s Ludwig estimates that the Right may spend as little as 1% of what the Left spends on voter registration efforts.
A recent memo from the Sentinel Action Fund, a super PAC that aims to elect conservatives, noted that in the 2022 election cycle, while $8.9 billion was spent on federal elections, there were zero large independent expenditure organizations on the Right focused on get-out-the-vote efforts or “ballot chasing.”
Republican Party vehicles and conservative outfits like grassroots-oriented Turning Point Action, a 501(c)(4), are engaged in such efforts in the 2024 cycle, but the scale and sophistication of their political counterparts’ efforts would appear unrivaled at this point.
Election experts attribute this gap to several factors beyond the GOP’s focus on other tactics to win elections, or ineffectiveness. They note that Democratic voters tend to be more concentrated in urban areas and college campuses, making it easier to run efficient registration drives. As regards early and absentee voting and ballot harvesting, it is not clear if these efforts will substantially grow the pool of Republican voters versus merely enabling the party to “bank” votes earlier.
With respect to the use of 501(c)(3)s to conduct such activities, Ludwig said some conservatives may still be fearful of running afoul of the IRS—through exploiting tax laws to pursue efforts perceived to be partisan effectively on the taxpayers’ dime—in the wake of its targeting of tea party groups for extreme scrutiny during the Obama years.
Since the 2020 election, Democrats have opened a second apparent electioneering front that Republicans could not match even if they wanted to: The rise of so-called Bidenbucks, which uses the “unlimited funding, resources, and reach” of the federal government and agency offices located nationwide to turn out favored voters, according to Stewart Whitson, legal director of the conservative Foundation for Government Accountability.
In March 2021, President Joe Biden introduced Executive Order 14019. The directive on “promoting access to voting” orders every federal agency, more than 600 in all, to register and mobilize voters—particularly “people of color” and others the White House says face “challenges to exercise their fundamental right to vote.” It further directs the agencies to collaborate with ostensibly nonpartisan nonprofits in pursuit of its goals.
As RealClearInvestigations has previously reported, Executive Order 14019 appears to have been designed by left-leaning think tank Demos and implemented in consultation and sometimes coordination with a slew of progressive, labor, and identity-focused groups with the goal of generating up to 3.5 million new or updated voter registrations annually.
The ACLU and Demos have reportedly helped execute the order. RealClearInvestigations additionally found that at least two recipients of grants under the Everybody Votes Campaign, the NAACP and UnidosUS—formerly the National Council of Raza—were also listed on an email as participants in a July 2021 listening session on the executive order convened by the White House and agency officials.
Whitson, whose organization unearthed that email in its fight to expose details about the order, emphasized that “[U]nlike 2020 wherein the shadow campaign was conducted by private citizens seeking to influence government election operations from the outside, the threat we face in 2024 is being launched from within the government itself.”
Facing both congressional scrutiny and litigation, the administration has closely guarded the strategic plans agencies were to develop to carry out the order, how they are implementing them, to what end, and with whom.
Perfunctory press releases, reports from groups supportive of the order, and documents slowly ferreted out via Freedom of Information Act requests and litigation, however, demonstrate that relevant agencies have sought to drive voter registration via public housing authorities, child nutrition programs, and voluntary tax preparation clinics.
In August 2023, U.S. Citizenship and Immigration Services issued updated guidance calling for the agency to register voters at naturalization ceremonies.
More recently, the Department of Education did the same, blessing the use of federal work-study funds to pay students for “supporting broad-based get-out-the-vote activities, voter registration,” and other activities. Scott Walter, president of the Capital Research Center, recently told The Epoch Times that the department had previously threatened schools “that you better be registering students or you could lose your federal funds.”
When asked by RealClearInvestigations to respond to Walter’s claim, the Department of Education would not. Over two dozen Pennsylvania state legislators challenged the order via a lawsuit in January. Citing alleged unlawful attempts by several agencies to register Keystone State voters, the lawmakers asserted:
By engaging in a targeted voter registration effort of this magnitude, focused specifically on these agencies and the groups of potential voters they interact with, leveraging the resources and reach of the federal government, this effort appears to be a taxpayer-funded get-out-the-vote effort designed to benefit the current President’s political party.
Echoing this view, Whitson’s Foundation for Government Accountability submitted an amicus brief noting that “all of the federal agencies FGA has identified as taking active steps to carry out EO 14019 have one thing in common: They provide government welfare benefits and other services to groups of voters the vast majority of which have historically voted Democrat.”
The plaintiffs alleged the executive order violated both Pennsylvania law limiting voter registration efforts to non-federal actors and constitutional provisions reserving election laws to the states.
On March 26, a district court dismissed the case, claiming the plaintiffs lacked standing. Whitson told RealClearInvestigations that others would likely lodge similar lawsuits, building on the Pennsylvania legislators’ case in the wake of the dismissal. Days later, The Federalist reported that the plaintiffs intended to appeal their case to the U.S. Supreme Court.
A White House spokesperson did not reply to RealClearInvestigations’ inquiries regarding the executive order.
Republicans have had more success opposing the use of Zuckerbucks and other private monies used to finance public elections. More than two dozen states would move to ban or restrict such grants in response to the activities observed during the 2020 election.
Most recently, Wisconsin, where some of the most controversial Zuckerbucks-related efforts took place, was added to that list when, on April 2, voters approved a constitutional amendment barring the private funding of elections.
Despite this crackdown and the feds seemingly stepping into the breach, efforts to privately finance election administration persist. The U.S. Alliance for Election Excellence bills itself as an initiative to bolster “woefully unsupported” election offices to “revitalize American democracy.”
The organization says it services jurisdictions—11 listed on its website, ranging across states from Arizona to California and Wisconsin—with “training, mentorship, and resources.” Alliance officials did not respond to RealClearInvestigations’ inquiry about whether it would be terminating the relationship with the city of Madison, Wisconsin, in light of the passage of the recent ballot measure that would seem to have barred it. Nor did it respond to RealClearInvestigation’ other inquiries in connection with this article.
Most of these partnerships were initiated with jurisdictions in states that have not banned Zuckerbucks, though it has sought to circumvent such prohibitions in Georgia and Utah. The stated goal of the Alliance for Election Excellence is to support voters via measures like assisting participating centers in “redesigning” forms to make them more intuitive and purchasing infrastructure “to improve election security and accessibility.”

Critics argue this seemingly more modest effort is, in reality, an ambitious Zuckerbucks rebrand.
Snead’s Honest Elections Project published a report in April 2023, based in part on documents received from FOIA requests, indicating “that the Alliance is a reinvention of CTCL’s scheme to use private funding to strongarm election policy nationwide.”
Among other takeaways, it found that:
The report shows that many of the alliance’s launch partners, starting with the Center for Tech and Civic Life and the Center for Civic Design, are funded by major Democrat-tied, so-called dark money groups such as the Democracy Fund and Arabella Advisors’ New Venture Fund and Hopewell Fund.
The Democracy Fund is led by Democrat tech billionaire Pierre Omidyar, which has granted some $275 million to like-minded organizations from publications like Mother Jones and ProPublica to the Voter Registration Project since its founding.
The District of Columbia recently closed a criminal investigation into Arabella, whose fund network reportedly spent nearly $1.2 billion in 2020 alone, after probing it over allegations its funds were pursuing political ends in violation of their tax-exempt statuses. The Center for Secure and Modern Elections, the Honest Elections Project says, pushes “left-wing priorities like automatic voter registration” and is run by the New Venture Fund. The Elections Group’s CEO and co-founder, Jennifer Morrell, previously served as a consultant at the Democracy Fund.
The Capital Research Center’s Walter uses a football analogy to explain why he sees these efforts as untoward. He told RealClearInvestigations:
Election offices are the refs in elections; the parties are teams trying to score. You’d be puzzled if you heard Super Bowl refs say they’re trying to boost points scored. You’d be outraged if you learned those refs had received money and training from people who previously worked for one team’s offensive coaching staff. That’s what left-wing political operatives, using left-wing money, are doing, and it’s clearly unfair.
Democrat-aligned groups continue to engage in litigation, like that brought by chief election lawyer Marc Elias, aimed at loosening election laws to their benefit. Snead told RealClearInvestigations, “There are more than 70 active lawsuits right now targeting voter ID laws, anti-ballot harvesting laws, signature verification, drop box regulations, and more.”
After securing victory in a lawsuit requiring signature verification for mail voting in Pennsylvania, the Republican National Committee touted its engagement as well in 81 election integrity cases this cycle. Swing-state Wisconsin is another major battleground for such efforts.
There, Elias’ legal team has challenged witness signature requirements and bans on election clerks filling address information on mail-in ballots. It and others are also working to overturn a state Supreme Court decision finding drop boxes illegal. The Badger State’s now liberal-majority Supreme Court announced in March it would take up the case.
Cutting against these efforts are not only the state’s citizen-approved Zuckerbucks ban, but another Badger-passed April 2 ballot measure amending the state’s constitution to prohibit those other than “an election official designated by law” from carrying out election-related tasks.
Watchdogs like Howell are concerned that left-leaning electioneers and lawfare forces collectively are pursuing an “election ‘dis-integrity’ strategy … to greatly expand the universe of ballots while limiting any ability to ensure that they are fairly cast and counted.”
“It’s a basic recipe for fraud.”
Elias says those seeking to combat such efforts are engaged in “voter suppression and election subversion.”
Democrats also have the federal government working on their side on the litigation front—and in ways extending beyond the veritable lawfare barrage the Biden Justice Department has leveled at Trump.
Speaking in Selma, Alabama, on the 59th anniversary of Bloody Sunday, the 1965 police assault on civil rights marchers, Attorney General Merrick Garland declared that “the right to vote is still under attack.”
Garland vowed the Department of Justice was punching back, including “challenging efforts by states and jurisdictions to implement discriminatory, burdensome, and unnecessary restrictions on access to the ballot, including those related to mail-in voting, the use of drop boxes, and voter ID requirements.”

A Nebraska state legislator is transitioning from blue to red after his own party censured him for having a pro-life stance. Nebraska state Sen. Mike McDonnell officially left the Democratic Party last week after 40 years and became a Republican.
In a written statement explaining his decision, McDonnell wrote: “I have asked the Democratic Party to respect my religious based pro-life position. Instead over the last year they have decided to punish me for being pro-life.”
Last month, the Nebraska Democratic Party voted to censure McDonnell, a Catholic, over his pro-life record, contending that his stance “adversely affected the reproductive rights of Nebraskans and the rights of transgender individuals in the state.”
Douglas County Democrats also voted in January to deny party funding to McDonnell due to his votes against abortion measures and against gender-transition procedures for minors.
“The state Democratic Party voted to censure me because I am pro-life,” McDonnell wrote. “Being a Christian, a member of the Roman Catholic Church and pro-life is more important to me than being a registered Democrat. Today I am changing my party affiliation to Republican.”
In a speech addressing his decision, McDonnell explained that he registered as a Democrat in 1984 and ran for the state Legislature in 2016.
“I wanted to see how we could grow our state and reduce property taxes at the same time,” he said. “I asked the Democratic Party of Douglas County to respect that I’m pro-life, that I’m a member of the Roman Catholic Church, and my beliefs are based on that. But Douglas County Democrats, instead of respecting that, they decided to punish it. … I continued to vote pro-life.”
“This is not an easy decision,” the state senator added. “After 40 years of being a registered Democrat, having your grandfather tell you when you’re 10 years old, ‘What are we? We’re Irish, we’re Catholic, and we’re Democrats.’ That kind of stuck with me.”
Pointing to his new Republican Party colleagues, McDonnell said: “Over the last year, regardless of my decision [on] switching parties, they have been so supportive. … We had great discussions about what the Republican Party is doing, where they’re trying to go, how I potentially could fit in there. But the greatest thing about [it] is now I can participate again.”
U.S. Sen. Pete Ricketts, R-Neb., a former governor of the state, responded to McDonnell’s decision by writing on X: “I am pleased to welcome Sen. Mike McDowell to the Republican team.” He added: “The extreme new Democrats are pushing commonsense officials and voters to our party.”
McDonnell is far from the only Catholic abandoning the Democratic Party due to what many consider mandatory abortion extremism.
Recent studies show that white American Catholics have been drifting away from the party for decades, but in increasing numbers over the past two decades, coalescing instead around the GOP.
A survey of Michigan voters found last month that former President Donald Trump, the presumptive Republican nominee credited with appointing three justices to the U.S. Supreme Court who enabled the dismantling of Roe v. Wade, holds a significant lead among Catholic voters over President Joe Biden, a Democrat and self-described Catholic.
A week ago, the Catholic archbishop of Washington, D.C., Cardinal Wilton Gregory, called Biden a “cafeteria Catholic” due to his rejection of the Catholic Church’s teaching on abortion.
In response to McDonnell’s new party affiliation, Nebraska Democratic Party Chairwoman Jane Kleeb issued a written statement saying: “The Nebraska Democratic Party will continue to stand up for reproductive freedom and the human rights of the LGBTQ community.”
Kleeb added: “Our decision to censure Sen. McDonnell was never about him being a pro-life Catholic. Our decision was based on our party reaffirming our core values to protect women’s ability to make health decisions and to keep politicians out of our personal health decisions.”

John Eastman is a lawyer, a legal scholar, and a friend.
I got to know John—a former clerk to Supreme Court Justice Clarence Thomas, candidate for California attorney general, and dean of Chapman University School of Law—during my weeklong 2018 legal fellowship with the Claremont Institute, which he oversaw. We have stayed in touch and done at least one event together for Claremont since that time.
Unfortunately, since the 2020 presidential election, John has been put through the wringer more than just about anyone in American public life.
He was forced to retire from the law school where he was a longtime constitutional law professor and even dean. He was let go by the University of Colorado’s Benson Center for Western Civilization, where he was a visiting scholar. Armed Stasi—sorry, FBI—agents accosted him in a parking lot and seized his phone without a warrant. He has been suspended from academic conferences and lost board seats. He and his wife have endured death threats, spikes in their driveway, and threatening graffiti in their neighborhood. He has been debanked by Bank of America and the USAA. He is being criminally prosecuted by scandal-ridden Fulton County, Georgia, District Attorney Fani Willis. And last week, State Bar Court of California Judge Yvette Roland devoted 128 pages to explaining why he should lose his law license.
All this because John had the chutzpah to do what every law school student is taught to do in legal ethics class: defend and zealously advocate for one’s client, no matter how unpopular or even disreputable that client may be. In this case, John’s unpopular client was a high-profile one: former President Donald Trump.
There has been an astronomical amount of misinformation about John’s activities in the weeks leading up to the Jan. 6, 2021, U.S. Capitol jamboree, as well as the legal advice that he offered his high-profile client during that time. The corporate media and the Democrat-lawfare complex typically speak of John’s legal advice as encouraging the “overturning of an election” or “fomenting an insurrection,” but such hyperbolic talk is irresponsible and wildly off base.
John acquitted himself well in a compelling essay he penned for Claremont’s American Mind online journal on Jan. 18, 2021, titled “Setting the Record Straight on the POTUS ‘Ask.'”
His 12th Amendment argument about the vice president’s more active role in certifying the states’ slates of electors and his accompanying argument regarding the constitutional dubiousness of the Electoral Count of 1887 might not be correct (although it could be), but it is well within the bound of plausible, nonfrivolous legal argumentation an attorney can (indeed, should) press upon an embattled client.
That is doubly so here, because the U.S. Supreme Court has never authoritatively interpreted the relevant 12th Amendment provision. Countless legal arguments more frivolous than this are advanced every day in courtrooms across America.
Nor is John Eastman the only man being prosecuted, and possibly disbarred, for his legal activity after the 2020 election. Former U.S. Assistant Attorney General Jeffrey Clark is also being prosecuted in Georgia, and he was just found by the District of Columbia Bar to have violated an ethics rule, which might lead to his own disbarment there—all stemming from an internal Department of Justice memo that Clark never even sent.
Once upon a time, the American Left understood the moral imperative of ensuring that all Americans have adequate access to legal representation, no matter one’s popularity in the eyes of the government or societal elites.
Indeed, the definitive American example of such unpopular legal representation actually dates back to before the United States was even independent: In 1770, a young lawyer named John Adams, the man who would become the young republic’s second president, took it upon himself to defend the British soldiers accused of killing five colonists at the Boston Massacre. Years later, in his dotage, Adams reflected that this was “one of the most gallant, generous, manly, and disinterested actions of my whole life, and one of the best pieces of service I ever rendered my country.”
Presumably, Willis and Roland would have preferred to see Adams tarred and feathered for his treachery. One also cannot help but wonder how they might have viewed the NAACP’s legal representation in the Deep South during the days of Jim Crow.
The ultimate aim of those Jacobins prosecuting and disbarring lawyers for having the temerity to practice the legal profession is clear: the subordination of the rule of law to the Jacobins’ own friend/enemy-level politics, and the cowing into submission of those lawyers who would so much as consider representing a high-profile Republican client or work in a Republican Department of Justice. Ironically, and without any hint of self-awareness, they do all this in the name of “our democracy.”

Ronna McDaniel, formerly chair of the Republican National Committee, was recently hired and subsequently fired by NBC News when the “talent,” unable to countenance even moderate dissent, revolted on air. The entire kerfuffle is unsurprising considering the state of modern “media.”
But one of the funniest moments of the McDaniel blowup came when host and former White House press secretary Jen Psaki, another political operative hired by NBC, argued that, actually, the distinction between her and McDaniel was “truth versus lies.”
What in the holy hell is she talking about?
Only last week, Psaki was lying about Donald Trump’s “bloodbath” comment—which every sentient being understands was a metaphor for economic collapse, not, as the MSNBC host explained, an “embrace of political violence” or “dehumanizing language.”
And let’s set aside the “election denialism” of the 2016 contest, which she claimed was “rigged” by Russia. Psaki is proficient in lies big and small, whether she’s spreading run-of-the-mill lies about how Democrats don’t support abortion until birth (almost all do) or whether she’s telling the press that President Joe Biden’s dog Major had not bitten Secret Service officers (he’s bitten them 24 times, at least), or she’s spreading hoaxes about Border Patrol agents “whipping” Haitian migrants, Psaki is a wellspring of misinformation.
Even considering the normal mendacious parameters of a White House press secretary, she excelled.
When Democrats were campaigning to cram through that massive welfare expansion agenda—first named “Build Back Better” and later “Inflation Reduction Act” [sic]—she told the media that “no economist” in the country was predicting higher inflation because of massive government spending. Biden, at least, had the decency to contend that a “serious economist” was warning of disaster.
Of course, numerous respected economists, including well-known Democrats, had warned that injecting trillions into a hot economy would exacerbate inflation, as Psaki well knew. She made her claim in November 2021. A month earlier, inflation had risen at its fastest rate since 1990.
During the Biden administration’s deadly botching of Afghan withdrawal, which saw 13 American servicemen murdered at the Abbey Gate outside Kabul’s Hamid Karzai International Airport, Psaki lied.
When the administration, tied to a political timeline, ignored warnings from intelligence officials that terrorists were taking advantage of unsecured paths that the U.S. was encouraging civilians to use to get to the airport, Psaki bragged that all “American citizens,” “Afghan partners,” and “allies” were being rescued.
When someone asked her how many Americans had been left behind in the country, she indignantly told them it was “irresponsible to say Americans are stranded.” But they were. John Kirby, Pentagon spokesperson, flippantly told the press only days later, “We have Americans that get stranded in countries all the time.” Everyone knew.
Later, the Senate Foreign Relations Committee found that as many as 9,000 Americans were left in Afghanistan during the Biden administration’s disastrous withdrawal. A nongovernmental organization report found that the U.S. “left behind” 78,000 Afghan allies in the chaotic withdrawal.
Then again, even before Psaki was a White House press secretary, she had been deputized to enact Iran-booster Ben Rhodes’ “echo chamber,” in which the Obama administration manipulated young, pliable, credulous journalists into spreading misinformation about a nuclear deal to empower the Islamic terror state, one of the administration’s highest priorities at the time.
When the State Department deliberately cut embarrassing answers within press briefing videos to avoid scrutiny over their concerted effort to mislead the media, Psaki lied to the American people about that as well.
That is only a small sample of the former press secretary’s prodigious work. And, no doubt, McDaniel lied for political expediency as well. But let’s face it, she is a mere piker next to Psaki.

The Biden Administration’s diplomacy with Israel over its war against Hamas has reached the Animal House “double-secret probation” stage, with Secretary of State Antony Blinken warning Israel that it may find itself diplomatically “isolated” in the world if it attacks Rafah. Is it possible for Israel to be any more “isolated” than it already is in the joke that is called “the diplomatic community”? Chaser—Fetterman does have some competition this week, from the Ragin’ Cajun himself, James Carville: “A suspicion of mine is that there are too many preachy females [dominating the culture of the Democratic Party].”
In his opening statement to the House Oversight Committee earlier this week, the glorious Mr. Tony Bobulinski torched Reps. Dan Goldman and Jamie Raskin:
We keep hearing from certain corners that our “democracy is at risk” and that “democracy is on the ballot in 2024,” yet the same people preaching this mantra, who know better, continue to lie directly to the American people without hesitation or remorse. Representatives Dan Goldman and Jamie Raskin, both lawyers, and Mr. Goldman a former prosecutor with the Southern District of New York, will continue to lie today in this hearing and then go straight to the media to tell more lies.
Mr. B., long may you run.
Professor Jonathan Turley takes it from there in the (highly recommended) Fox News column that he has now posted at his personal site: “The Dripping Away of the Democratic Party: Sir Thomas More and the Biden Corruption Scandal.” In the introduction to the column posted on his site, Professor Turley writes (links omitted): “Various members misrepresented my earlier testimony during the hearing on the basis for the impeachment inquiry. Members like Rep. Jamie Raskin (D., Md.) stated that I joined other witnesses in saying that there was nothing that could remotely be impeachable in these allegations. That is demonstrably untrue. My testimony stated the opposite.”
What about Goldman? You can’t leave him out:
Rep. Dan Goldman, D., N.Y., captured the problem for Democrats in even addressing any of the mounting evidence contradicting the president. Yet, Goldman has long shown a willingness to rush in where angels fear to tread.
In previous attacks, Goldman repeatedly hit the Bidens with friendly fire when eliciting damaging answers from witnesses. Goldman has a habit of raising the worst evidence that his colleagues have avoided. In one hearing, he stumbled badly in raising the WhatsApp message where Hunter told a Chinese businessman that his father was sitting next to him and would not be pleased unless he sent him money. On another occasion, he prompted an IRS whistleblower to note that an email Goldman read into the record was actually a direct contradiction of the denials of the president.
In the latest misstep, Goldman pressed former Biden partner Tony Bobulinski on a proposal shared with Hunter and others to reserve 10% for “the Big Guy.” In other emails, Bobulinski was told to use such codes to avoid mentioning Joe Biden’s name. He was expressly identified as “the Big Guy.” Video
Goldman snapped at Bobulinski, “Did anyone ever respond to that email?”
Bobulinski responded “Yes, they did numerous times. Hunter himself did.”
Goldman blurted out “you’re right” before angrily reclaiming his time to cut him off.

In a long speech on the floor yesterday Senate Majority Chuck Schumer called for the replacement of the current Israeli government under Prime Minister Benjamin Netanyahu. The Times of Israel has posted the full text of Schumer’s remarks here. According to Schumer, Netanyahu is an obstacle to peace, the two-state final solution, and the Big Rock Candy Mountain. We must popularize the phrase “He doesn’t know Schumer from Shinola.”
Jonathan Tobin places Schumer in the context of his career to date: “He’s been in public office continuously since the age of 25, and the 73-year-old Senate Majority Leader has spent his adult life grandstanding for the cameras and the press while always seeking some momentary political advantage as he schemed, back-stabbed and bloviated his way to the top of his profession.”
We can infer that Schumer now approves of foreign interference in another country’s elections. Only yesterday that was a big no-no for purported thought leaders toeing the Democrat Party line.
In this case the government Schumer seeks the replacement of a government that was democratically elected and formed by a close American ally fighting for its life under extremely difficult circumstances. That’s no way to treat a friend.
Schumer pretends that the relevant policies of the Netanyahu government are peculiar to Netanyahu and his coalition. That does not seem to be the case.
Schumer gives aid and comfort to Hamas and its friends in the Democratic Party. We can infer that the obstacle posed by Netanyahu is to the political objectives of the Democratic Party as conceived by President Biden.
Biden has just renewed his sanctions waiver on $10 billion held for the genocidaires of Iran. See Richard Goldberg’s New York Post column “Biden continues Iran’s access to $10 billion just weeks after its proxy killed three American soldiers.” Biden — he doesn’t know Schumer from Shinola.
One has to wonder about the impact of Schumer’s speech in Israel. It can’t help but demoralize Israelis fighting for their lives. However, they are unlikely to think they need Schumer’s help to assess their own best interests. In articulating and pursuing Israel’s war aims, Netanyahu speaks for the people of Israel. They do not support surrender to Hamas or adoption of the two-state final solution.
Senator Tom Cotton has posted a statement responding to Schumer. Senator Cotton sees the unstated obstacle Schumer is addressing: “[T]he main elections that worry Chuck Schumer aren’t Israel’s but our elections because the rampant antisemitism that the Democratic Party has allowed to fester in its ranks is massively unpopular with the pro-Israel American public.” Senator Cotton adds this “come to Jesus” element to his statement for Schumer’s benefit: “Chuck Schumer should remove the log in his own party’s eye before he whines about the speck in Israel’s eye.”
This is a good complement to Steve’s post immediately below. Why did Democrats decide, seemingly in unison, that it would be a good idea to enable millions of illegal immigrants? Because they (or, in any event, their children) will be voters, and the Democrats assumed they could count on minority votes for many years to come.
But that may have been a miscalculation:

This is part of the broader realignment of the parties. The left’s current obsessions–the “trans” movement, global warming, the war on food and gasoline, and so on–are of no good whatsoever to working people. They are of interest primarily to wealthy whites, especially wealthy white women. Blue collar minorities, like other working people, are not stupid. They can see that it is the Republicans whose policies actually help them, and they are starting to vote accordingly.
Joe Biden can’t get far enough left to satisfy his base. In last night’s SOTU, he referred to Jose Ibarra, the career criminal who *allegedly* beat Laken Riley to death, as an illegal immigrant. Which is exactly what he is, although the correct legal term is “illegal alien.” Bizarrely, liberals were outraged, not that Biden referred to Ibarra as a murderer, but that he called him an illegal immigrant. Specifically, President Biden was referring to the illegal immigrant who has been charged with murder in the killing of Laken Riley.

In response, left-wing Democrats have expressed outrage that President Biden referred to this criminal, illegal alien as an “illegal.” Just after President Biden’s speech concluded, Congresswoman Ilhan Omar of Minnesota put out a social media post on X saying, “Let me be clear: No human being is illegal.”This message was parroted by Democrats all over the country. In Minnesota, state Rep. Maria Isa Perez-Vega, D-St. Paul, re-posted Congresswoman Omar’s message. Jason Chavez, a member of the Minneapolis City Council, also put out a statement saying, “No human is illegal.”
A myriad of other Democrats, including Congresswomen Cori Bush, Ayanna Pressley, and Delia Ramirez, put out social media posts with the exact same message. Last night, Nancy Pelosi went on CNN and said President Biden should have used the word “undocumented” when referring to the illegal alien.
Congressman Chuy Garcia, D-Illinois, put out a statement saying, “As a proud immigrant, I’m extremely disappointed to hear President Biden use the world ‘illegal.’”
Breaking the law is illegal. Is that really so hard to understand? And, oh–by the way–murder is illegal, too. Although liberals seem to care a lot less about a young woman who was beaten to death than they do about policing their wacko speech code. But I suppose there is nothing surprising about that.
Politico reports that Arizona Attorney General Kris Mayes (a Democrat, of course) is accelerating an investigation that may lead to prosecutions of people close to President Trump’s 2020 campaign. Which is odd on its face, since the events that are the basis for the investigation happened more than three years ago. Why the sudden hurry? Obviously, Democrats see that Joe Biden is losing, and are throwing the kitchen sink at Trump:
Arizona prosecutors in recent weeks issued grand jury subpoenas to multiple people linked to Donald Trump’s 2020 campaign, a sharp acceleration of their criminal investigation into efforts to overturn Joe Biden’s victory in the state.
The new steps, first reported here, are a sign that Attorney General Kris Mayes, a Democrat, is nearing a decision on whether to charge Trump’s allies in the state, including GOP activists who falsely posed as presidential electors in December 2020.
“Falsely posed as electors.” What an absurd characterization! In a number of states, Trump’s campaign had people lined up to be electors on his behalf in the event that his various legal challenges might succeed before the Electoral College met. There is nothing wrong with this, let alone illegal. The same thing happened in Hawaii in 1960, and would have happened in Florida in 2000 if the Supreme Court hadn’t first put the matter to rest.
The “fake elector” theory is one of several ways in which the Democrats have tried to criminalize making claims of voter fraud. In the wake of the 2020 election, Donald Trump and many others believed that the election had been stolen by the Biden campaign. Were they right? I doubt it, but we will never know for sure. There wasn’t enough time between the election and Biden’s inauguration for claims of voter fraud to be litigated on the merits, and in no case did any court ever permit the necessary discovery, conduct a trial and make findings on the extent of voter fraud by the Democrats.
In multiple criminal proceedings, Trump is accused of “trying to overturn” — or “plotting to overturn” — the result of the 2020 election. Again, there is nothing wrong with this. Al Gore tried to overturn the result of the 2000 election, and Al Franken got into the U.S. Senate by overturning the result of an election. There is nothing wrong with pursuing legal election remedies. And where extensive voter fraud is suspected, an attempt to investigate, litigate and overturn a fraudulent result is commendable, not criminal. But the reality is that voter fraud can only be prevented; it can’t be litigated and corrected after the fact. The Democrats have blocked common-sense ballot security measures at every opportunity, and they have no one but themselves to blame if the public widely suspects that our elections are rigged.
Sadly, it appears that some Trump associates have been bullied into guilty pleas in shameful criminal proceedings alleging that they were “fake electors.” This reflects the reality that government at either the federal or the state level can destroy your life at will. At some point, nearly everyone will surrender rather than go through bankruptcy and see his or her life destroyed.
The misuse of criminal proceedings by the Democratic Party to punish its political opponents is the most vicious legacy of our current political crisis.
Digging deep into the Super Tuesday primary results, I foresee President Biden facing off for a rematch against President Trump. Can you feel the excitement? The two candidates represent juggernauts within their respective parties.
Let’s take the Democrats first, courtesy of RealClearPolitics. What we have here is one full boatload of results. They raise the question: who is Marianne Williamson and what is she doing here? She is the best-selling author of a variety of books including A Return to Love: Reflections on the Principles of a Course In Miracles, A Woman’s Worth, Illuminata, The Healing of America, and Illuminated Prayers. Her books have been translated into more than twenty languages. Williamson continues to inspire audiences on a global scale as she lectures internationally in the fields of spirituality and new thought.
I infer from the results that Democrats resist the light. They resist new thought. Also, we don’t have a prayer. We need a miracle.
Biden’s presents himself as a throwback to the old-fashioned Democratic Party, yet he has adopted the policies of party’s far left. Most prominent among these policies is the opening of our borders and the implicit rejection of the sovereignty of the United States. Over the past three-plus years these policies have wrought great damage. Biden wants to test the outer limits of Adam Smith’s proposition that “There is a great deal of ruin in a nation.” One can’t help but wonder if we can put ourselves back on track.
It’s not Joe Biden’s Democratic Party. It’s the woke left’s Democratic Party. It’s the party of those who say the things which are not.
Biden made an appearance during the narrow window of his waking hours yesterday. He appeared to have dropped in from outer space. He sounded like he had not been briefed since he blasted off from his homeworld. J.B., phone home.

On the Republican side of Super Tuesday (also courtesy of RCP), President Trump wrapped up the Republican nomination. Nikki Haley will suspend her campaign later this morning.
This is Donald Trump’s Republican Party. If President Trump were to keel over and leave us with an open convention in Milwaukee next July, I assess the odds that the delegates would turn to Haley at zero. It would be a politician in the mold of Trump — probably Ron DeSantis, or perhaps J.D. Vance or Vivek the Mistake. Trump has transformed the Republican Party. By contrast with Biden and the Democrats, he has stamped the party in his image.
I am surprised by the not insubstantial fraction of votes that Haley pulled yesterday. Some portion of the Haley represents Democrats voting in open primaries. Haley won Vermont, but even if she were the nominee she would lose it in November. Vermont is a socialist state. I’m not talking about Vermont. Assuming Trump can survive the Democrats’ lawfare, he cannot win without a united Republican Party. He has some work to do to put the Republican house together. His choice for vice president could help.
It is difficult to project the state of play in the coming months. My crystal ball is cloudy. Much depends on the course of the Democrats’ lawfare against Trump and, to a lesser extent, the nature of the campaign Trump runs. I think he best serves his own interests at this point when he is out of the news and provides the alternative to Biden. If the election can be reduced to a binary choice, Biden should lose. The Democrats’ lawfare means to preclude that.
Yesterday brought more news of the illegal immigration that Biden has invited, inflicted, facilitated, fostered. Biden’s derelictions in office are historic in nature. The Daily Mail reports, for example, “Biden administration ADMITS flying 320,000 migrants secretly into the U.S. to reduce the number of crossings at the border has national security ‘vulnerabilities.'” The New York Post reports “Elon Musk says Biden flying 320K ‘unvetted’ migrants into the US sets stage ‘for something far worse than 9/11.’” Elon Musk — he’s no dummy.
The true numbers involved in the invasion that Biden invited are staggering, whatever they are, as are the secondary effects. As I say, we need a miracle, or something like it.
Kyrsten Sinema announced today that she will not seek reelection to her Arizona Senate seat:
Sinema’s move is significant but not unexpected. She raised only $595,000 in the final quarter of 2023, a fraction of the totals that Lake and Gallego each raised — although Sinema maintains nearly $11 million in her campaign account.
So it sounds like her mind was made up a while ago. Sinema’s withdrawal means the race will be between Republican Kari Lake and Democrat Representative Ruben Gallego. Gallego is a far leftist; this is how Lake describes him:
He votes with Joe Biden 100% of the time, supported the Iran Deal, sanctuary cities, defunding the police, and voting rights for everyone pouring across the border. He even called the border wall “stupid.”
Lake will now be a heavy favorite to flip the Senate seat, obviously a desirable outcome. But I am a little sorry to see Sinema go. She was an old-fashioned–i.e, sane–Democrat. A dinosaur, in other words. While she no doubt voted with the Dems most of the time, there were important instances, as for example the original “Build Back Better” disaster, when she stood in the breach on behalf of the Republic. And I have it on good authority that she couldn’t stand her Democratic colleagues, which perhaps contributed to her decision to walk away.
In any event, while Kari Lake will likely mark an important step toward restoring Republican control of the Senate, we owe Kyrsten Sinema a debt of gratitude.
In 2001, 2005 and 2017, some Democrat House members objected to the certification of electoral votes for the winning Republican presidential candidate. Those objections, while “denialist,” were only symbolic. But Democrat leaders in the House are now suggesting that if they control that body following November’s election–as they well might–they may refuse to allow a victorious Donald Trump to take office.

Murray and other legal scholars say that, absent clear guidance from the Supreme Court, a Trump win could lead to a constitutional crisis in Congress. Democrats would have to choose between confirming a winner many of them believe is ineligible and defying the will of voters who elected him. …

But during oral arguments, liberal and conservative justices alike seemed inclined to dodge the question of his eligibility altogether and throw the decision to Congress.
“That would be a colossal disaster,” Representative Adam Schiff of California told me. “We already had one horrendous January 6. We don’t need another.” …
The choice that Democrats would face if Trump won without a definitive ruling on his eligibility was almost too fraught for Representative Jamie Raskin of Maryland to contemplate. He told me he didn’t know how he’d vote in that scenario. As we spoke about what might happen, he recalled the brutality of January 6. “There was blood all over the Capitol in the hypothetical you posit,” Raskin, who served on the January 6 committee with Schiff, told me….
The Democrats have become so insane on the subject of Donald Trump that it is hard to know which of their mutterings to take seriously. But if Trump wins the election and a Democrat-controlled House refuses to certify his election on the ground that he is an “insurrectionist” under the 14th Amendment, we will be past the point of a constitutional crisis. If that happens, the only realistic path forward will be disunion, possibly accompanied by civil war, but preferably not.
This is one reason why the Supreme Court should put the 14th Amendment theory out of its misery, once and for all. It is obvious that the drafters of that amendment meant the just-concluded Civil War, in which 600,000 Americans lost their lives, when they referred to “insurrection or rebellion” against the United States. In contrast, the January 6 protest was not one of the 50 most destructive riots of the last few years, and the only person killed was Ashli Babbitt. Not a single participant in the protest was arrested in possession of a firearm. Some insurrection!
In the interest of preserving the Republic, the Supreme Court should rule definitively that Section 3 of the 14th Amendment does not apply to Donald Trump.
Fani Willis’s prosecution of Donald Trump has descended into comedy, currently of the bedroom farce variety. As all the world now knows, Willis carried on a torrid affair with Nathan Wade, whom she hired to lead the Trump prosecution and to whom she paid an extraordinary amount of taxpayer money, and then helped him spend it. That is corruption of the most old-fashioned sort. Willis and Wade have claimed that their affair did not begin until 2022, some time after she hired him to prosecute Trump.
Which turns out to be a lie:
Phone records, recently unveiled in new court documents obtained by The Post, indicate a pattern of late-night visits by Wade to Willis’s apartment, raising questions about the timeline of their relationship.
According to the cellphone data presented in court, Wade frequented the vicinity of Fulton County District Attorney Willis’s condo in Hapeville at least 35 times before their confessed affair.

[Investigator Charles] Mittelstadt highlighted times that refuted both Wade’s and Willis’s testimony that they had not begun a relationship prior to November 2021, and that he had only visited the apartment on occasion to discuss business.“I was directed into a deeper analysis on two specific dates: September 11-12, 2021 (before I understand Mr Wade was hired) and November 29-30 (prior to what I understand was the in-court testimony that the romantic relationship began in 2022).
“Specifically, on September 11, 2021, Mr Wade’s phone left the Doraville area and arrived within the geoface located on the Dogwood address [Willis’s condominium] at 10.45pm,” Mittelstadt said.
“The phone remained there until September 12 at 3.28am at which time the phone traveled directly to towers located in East Cobb consistent with his routine pinging at his residence in the area. The phone arrived in East Cobb at approximately 4.05am, and records demonstrate he sent a text at 4.20am to Ms Willis.
“Additionally, on November 29, 2021, Mr Wade’s phone was pinging on the East Cobb towers near his residence and, following a call from Ms Willis at 11.32pm, while the call continued, his phone left the East Cobb area just after midnight and arrived within the geofence located on the Dogwood address at 12.43am on November 30, 2021. The phone remained there until 4.55am,” he added.
Willis and Wade are the most famous illicit couple since Peter Strzok and Lisa Page. Like Strzok and Page, Willis and Wade appear to have made texting and phoning one another a full-time job:
Mittelstadt’s report also showed Wade and Willis had made more than 2,000 voice calls to each other and exchanged just less than 12,000 text messages over an 11-month period in 2021.
It makes you wonder when Wade found time to rack up all those billable hours.
I don’t know what the future holds for Donald Trump, but I think we can confidently predict that the Sun soon will set on Fani Willis’s political career.

January 16, 2021The Totalitarian Left Moves to Silence All Dissent
In an article that was picked up by the Mercury News, Ethan Baron of the Bay Area News Group wrote Tuesday that “A week after false claims of a stolen U.S. presidential election drove a deadly insurrection at the U.S. Capitol, Twitter is allowing a far-right supporter of President Donald Trump to claim the election was stolen.” Baron’s intention was clear: he wants Twitter to ban me, as it banned Trump, for telling truths they want buried. His article shows how monstrous and totalitarian the left really is: leftists think they can publicly call for the censuring and banning of someone whose views they hate, and just like that, you disappear.The left and its propaganda arm, the establishment media, are now working hard to make it illegal, and get you banned from social media, to state the obvious fact that the election was stolen. The Democrats are seeking to criminalize and penalize anyone who says theelection was stolen. Their “insurrection” hoax, and impeachment of the president without due process or giving him the chance to defend himself, is designed to shut down any and all talk of their infamous election fraud. This is not the behavior of people who know they won fair and square and are watching their opponents have a tantrum about it. This is the action of the guilty.
That said, the election was stolen. The mountains of evidence of election fraud were never examined in any court, and then we were told that there was no evidence at all, or if there was any, it had already been dismissed in court challenges. The court cases were all dismissed on technicalities and procedural issues, not because there was no evidence of voter fraud. That evidence has still not been examined.
But it is a hallmark of the rapidly advancing totalitarianism of our age that thumbsuckers like Ethan Baron think they can kill you with righteous indignation. He wrote: “Anti-Muslim activist Pamela Geller, in a tweet Monday about banks freezing political donations after a pro-Trump mob stormed the seat of the U.S. government, said the banks’ decision was, ‘Further proof the election was stolen.’” I am not “anti-Muslim” any more than foes of the Nazis were “anti-German,” but that’s another story. Baron offered no counterargument to my contention about the banks. He just presented it as if it were self-evidently false and egregious.
Baron knew, of course, that he didn’t have to show that what I said was inaccurate. All he had to do was point out that I had deviated from the leftist line, and the jackbooted neo-fascists who run Twitter and the other social media platforms would spring into action.
It was reminiscent of the media outrage that was directed at me in May 2015, when I hosted the Muhammad Art Exhibit and Cartoon Contest in Garland, Texas that was the site of the first ISIS attack on American soil. I was raked over the coals not just on CNN, but also on Fox, which hadn’t yet switched sides then, and by conservative spokesmen who should have known better. I was defending the freedom of speech against violent intimidation. We never saw the hate and attacks that were directed at me in the wake of that event in Garland directed at the Fort Hood jihadi, the Times Square jihad bomber, the Christmas Tree Lighting Ceremony jihad bomber, the Boston Marathon jihad bombers, the New York subway jihad bomber, or any other jihadis.
We have never seen the media hatred and anything like the attacks that were directed at me directed towards the jihadists who beheaded journalist after journalist (their own!), or towards those who beheaded hundreds of Christians, executed them because they were non-Muslims, or towards the perpetrators of the ongoing genocide of non-Muslims and secular Muslims in Muslim countries.
If we had a responsible media, they would stand for the freedom of speech as we did in Garland. If we had a responsible media, it would be applauding the fact that some people are still standing up and telling the truth about the election despite the immense pressure from powerful forces to stop doing so.
How do these people not understand this most basic, elemental concept of freedom?
I didn’t start this war for the freedom of speech, but I won’t lie down and submit, either. Twitter and the rest may heed Baron and ban me. But even then, this isn’t over. What remains to be seen is whether the free world will finally wake up and stand for the freedom of speech, or instead kowtow to this evil and continue to denounce me and others like me. What’s really frightening and astonishing about this assault on our freedom of speech is the number of people cheering on the silencing of dissent from the establishment line. I never expected that from my fellow Americans. But if the darkness of totalitarianism does come to the United States, it will be thanks to them and to the likes of Ethan Baron.

The AIPAC Boycott and Obama

NBC News reported Thursday that “several Democratic presidential candidates will skip the American Israel Public Affairs Committee’s policy conference this year after a prominent progressive group called on them to boycott the event.” This has been a rapid descent. In 2017, Kamala Harris said it was “an honor” to speak before AIPAC. But as quickly as the Democrats’ Jew-hatred is being normalized now, it has also been a long time coming. I warned about it over ten years ago.The candidates who are boycotting AIPAC include senators Elizabeth Warren, Kamala Harris, and Bernie Sanders, as well as Beto O’Rourke, Pete Buttigieg, Julian Castro, and Howard Schultz. According to NBC, “the candidates’ decisions to skip the prominent pro-Israel lobbying group’s conference come one day after liberal group MoveOn.org called on all 2020 presidential candidates to steer clear of the event.”
The Democrats are now officially the party of Jew-hatred. This is largely due to the disastrous presidency of Barack Hussein Obama. It was Obama, with his consistently shabby treatment of Benjamin Netanyahu and relentless demonization of Israel, who mainstreamed and normalized anti-Semitism among the Democrats.
I warned about it all. In May 2008, before Obama was elected, a reader invited me to a senior-level AIPAC event at Cipriani’s. I went up to the Executive Director, Howard Kohr, and said that I understood AIPAC was “nonpartisan, but Obama will be lethal for the Jews.” Kohr scoffed. I went on to relate all that I had unearthed in my two years of relentless investigation of Obama, and I laid it out, point by point, fact by fact, with as little hyperbole as possible. Kohr shook his head. He would have none of it. We are nonpartisan, he insisted. To what point are you nonpartisan? If there is a candidate, a party, an official that is a Jew-hater, do you maintain neutrality, like Switzerland? He just smiled and walked away.
I meticulously documented Obama’s Jew-hatred, and his entourage of Jew-haters, in my book The Post-American Presidency: The Obama Administration’s War On America. I noted in that book that the American Jews who voted so overwhelmingly for Obama could have and should have seen his anti-Semitism and how he would normalize Jew-hatred in the Democrat Party. Take, for example, of a March 2007 account by the pro-Palestinian blogger Ali Abunimah at the the Electronic Intifadah website. Abunimah recounted how Obama had adopted a pro-Israel position as a matter of political expediency as his national aspirations developed. “The last time I spoke to Obama,” Abunimah recalled, “was in the winter of 2004 at a gathering in Chicago’s Hyde Park neighborhood. He was in the midst of a primary campaign to secure the Democratic nomination for the United States Senate seat he now occupies. But at that time polls showed him trailing.”
When Abunimah greeted him, Obama “responded warmly,” and volunteered an apology for not being more outspoken against Israel: “Hey,” said the candidate to Abunimah, “I’m sorry I haven’t said more about Palestine right now, but we are in a tough primary race. I’m hoping when things calm down I can be more up front.” Abunimah added: “He referred to my activism, including columns I was contributing to the The Chicago Tribune critical of Israeli and US policy, ‘Keep up the good work!’”
Abunimah’s piece — and Obama’s numerous anti-Semitic associations — got little attention. Throughout his life Barack Obama has been close friends with numerous virulent anti-Semites: Jeremiah Wright, Bill Ayers, Khalid al-Mansour, Rashid Khalidi and others.
It may be an old cliché, but it’s true: show me your friends, and I’ll show you who and what you are.
American Jews should have noted this, and noted it well. Instead, they fell for Obama’s smooth talk. But when Obama became president, he was true to his word to Abunimah, and turned viciously against Israel. And the whole world should have seen it coming.
Everything that is happening now in the Democratic Party — the relentless pandering to the Jew-haters Ilhan Omar, Rashida Tlaib, and Alexandria Ocasio-Cortez, the abject failure and collapse of the effort to rebuke Omar for her Jew-hatred, even indirectly, the boycott of AIPAC by the presidential candidates — I predicted and warned about. All my warnings are coming true. What does Howard Kohr have to say now?

I went on to relate all that I had unearthed in my two years of relentless investigation of Obama, and I laid it out, point by point, fact by fact, with as little hyperbole as possible. Kohr shook his head. He would have none of it. We are nonpartisan, he insisted. To what point are you nonpartisan? If there is a candidate, a party, an official that is a Jew-hater, do you maintain neutrality, like Switzerland? He just smiled and walked away.
When Abunimah greeted him, Obama “responded warmly,” and volunteered an apology for not being more outspoken against Israel: “Hey,” said the candidate to Abunimah, “I’m sorry I haven’t said more about Palestine right now, but we are in a tough primary race. I’m hoping when things calm down I can be more up front.” Abunimah added: “He referred to my activism, including columns I was contributing to the The Chicago Tribune critical of Israeli and US policy, ‘Keep up the good work!’”
Abunimah’s piece — and Obama’s numerous anti-Semitic associations — got little attention. Throughout his life Barack Obama has been close friends with numerous virulent anti-Semites: Jeremiah Wright, Bill Ayers, Khalid al-Mansour, Rashid Khalidi and others.
It may be an old cliché, but it’s true: show me your friends, and I’ll show you who and what you are.
American Jews should have noted this, and noted it well. Instead, they fell for Obama’s smooth talk. But when Obama became president, he was true to his word to Abunimah, and turned viciously against Israel. And the whole world should have seen it coming.
