‘She Lied Under Oath’: Sen. Mike Lee Calls for DOJ’s Kristen Clarke to Resign

Republican Utah Sen. Mike Lee is calling for the resignation of Kristen Clarke, the head of the Justice Department’s Civil Rights Division.

Kristen Clarke is in charge of enforcing civil rights laws,” Lee said in a statement posted to X on Tuesday evening. “She enforces those laws aggressively against anyone who sneezes near an abortion clinic. And not at all against those who vandalize churches. She lied under oath during her confirmation proceedings, and should resign.”

“She lied under oath to mask her arrest for committing a violent crime, yet she zealously prosecutes peaceful pro-life protesters,” the senator added.

Kristen Clarke is in charge of enforcing civil rights laws.

Lee weighed in on Clarke following a Daily Signal report revealing that Clarke, who testified in 2021 to senators that she had never been arrested for or accused of committing a violent crime, was involved in a violent domestic dispute with her now ex-husband, one in which he alleged that she sliced his finger to the bone with a knife.

Court documents, records, and text messages obtained by The Daily Signal indicate that Clarke was arrested, but that arrest was ultimately expunged.

“Since becoming a legal adult, have you ever been arrested for or accused of committing a violent crime against any person?” Sen. Tom Cotton, R-Ark., asked then-nominee Clarke in 2021, to which she responded, “No,” according to responses she submitted to the Senate under oath in a document called “Questions for the Record.”

Neither Clarke nor the DOJ has responded to requests for comment from The Daily Signal. The FBI, asked about the background checks it performed on Clarke, declined to comment.

Ed Whelan, senior fellow at the Ethics and Public Policy Center where he holds the Antonin Scalia Chair in Constitutional Studies, similarly called for President Joe Biden and Vice President Kamala Harris to demand Clarke’s resignation.

“Kristen Clarke, loony ideologue at DOJ on transgender issues, appears to have flat-out lied under oath during her confirmation process when she denied ever having been arrested,” Whelan said in an X post on Tuesday night.

“Per article, she was arrested in 2006 for attacking her then-husband with a knife and slicing his finger to the bone,” he continued, before adding: “President Biden and AG [Attorney General Merrick] Garland should demand her resignation.”

“Expungement of arrest record has consequences under Maryland law, but it can’t excuse Kristen Clarke for falsely stating to Congress during her confirmation process that she had never been arrested for committing a violent crime,” Whelan said.

Whelan further suggested that the establishment media may abstain from covering Clarke out of a bias for Democratic nominees.

“If news broke that controversial DOJ official in Republican administration lied during confirmation process to conceal arrest for violent crime, it would be front-page news in NYT and WaPo,” Whelan said, referring to The New York Times and The Washington Post. “We’ll see if they pay any attention to Kristen Clarke’s lie.”

Clarke was nominated by then-President-elect Biden on Jan. 7, 2021, and later confirmed by the U.S. Senate on May 25, 2021, to lead the DOJ’s Civil Rights Division.

The Daily Signal previously reported that Clarke, who oversees investigations into violations of the Freedom of Access to Clinic Entrances (FACE) Act, has used FACE to charge dozens of pro-life individuals since the overturn of Roe v. Wade. This includes Mark Houck, a Catholic father of seven arrested at gunpoint by the FBI and charged with violating FACE in September 2022.

A jury found Houck was not guilty in January 2023.

Pregnancy Center Slams FBI For Failure to Arrest Pro-Abortion Firebombers

Staffers at a pro-life pregnancy resource center in Rochester, New York, are criticizing the FBI for failing to provide any kind of status update of investigations into pro-abortion vandals’ attacks on the pregnancy center.

Nearly two years after the initial June 2022 attack, CompassCare pregnancy medical center says that the FBI has put up billboards offering a $25,000 reward for any information leading to the arrest of the criminals who firebombed the pregnancy center.

The billboard is placed about a mile away from the center, CompassCare said in a release. The group added that the billboard appeared shortly before the sentencing of a separate pro-abortion arsonist, Hridindu Sankar Roychowdhury, who in December pleaded guilty to attacking a pro-life organization in Madison, Wisconsin.

CompassCare says that the FBI won’t communicate with them about the billboard, first noticed by the organization on April 1, and won’t provide a status update on its investigation into the attack.

“Supporters have asked if CompassCare paid for this expensive billboard,” said the Rev. Jim Harden, CompassCare CEO, in a statement provided to The Daily Signal. “We did not. The FBI refuses to communicate.”

“The erratic nature of [Department of Justice] and FBI behavior around cases of violence against pro-life groups appears to be PR related, bolstering their reputation when under pressure to produce results by media and congressional judiciary committees,” Harden speculated.

“Perhaps they anticipate more violence against Christian pro-lifers ahead of the next big Supreme Court ruling in June and want to make it look like they care?” he questioned.

The FBI and DOJ did not immediately respond to requests for comment for this article.

CompassCare was attacked a second time in March 2023. The Daily Signal’s Virginia Allen reported at the time that surveillance footage from the attack showed an individual wearing a hoodie walk up to the front of the pregnancy center, spray paint the word “Liars” over the CompassCare sign, then walk away back down the street. 

The radical pro-abortion group Jane’s Revenge took responsibility for the June 2022 firebombing of the pro-life center. Pro-abortion activists also spray-painted the words “Jane was here” on the side of the building.  

Since the May 2022 leak of the draft Supreme Court opinion indicating that Roe v. Wade would soon thereafter be overturned, there have been at least 236 attacks on Catholic churches and at least 90 attacks on pro-life pregnancy centers, according to Catholic Vote trackers.

The Freedom of Access to Clinic Entrances Act (FACE Act) prohibits the intentional destruction or damage of reproductive health care facilities, theoretically protecting not only abortion clinics, but also pro-life churches and pregnancy centers.

But President Joe Biden’s DOJ charged only pro-life activists with FACE Act violations in 2022, and has since charged only five individuals with violating the FACE Act by targeting pregnancy centers.

In February, conservative leaders called on House Judiciary Committee Chairman Jim Jordan and Speaker of the House Mike Johnson to pass the FACE Act Repeal Act of 2023 “as soon as possible.”

“In the aftermath of additional pro-life activists being convicted by the Biden administration under the FACE Act for peacefully protesting outside an abortion business, we respectfully urge you to take immediate legislative action to protect peaceful pro-life activists from the Biden administration’s weaponized Department of Justice and an unconstitutional law,” the leaders said in a letter first obtained by The Daily Signal.

“The Biden administration has weaponized the FACE Act against peaceful pro-life sidewalk counselors and activists who want to save lives and change hearts and minds,” Advancing American Freedom Executive Director Paul Teller told The Daily Signal at the time.

White Christians Not a Threat, Border Not Secure

DHS Secretary Alejandro Mayorkas claims, “The border is secure,” and President Joe Biden said, “The most dangerous terrorist threat to our homeland is white supremacy.” Not only are they both lying, but they are also ignoring the reports produced by the US Intelligence Community, including the Department of Homeland Security (DHS) and the Department of Defense (DoD).

Biden appointees, including the president himself, have claimed that the border is secure and that white Christian nationalists are the greatest threats to national security. These statements weaken our ability to address real threats. If the border is secure, then funding for additional security would be unjustified. And if Biden starts wasting public funds and security resources to hunt down white Christians, he will be leaving the country open to attacks from the real threats: China, Russia, North Korea, Iran, and Islamic extremists.

President Trump said he would deport illegal aliens. Kamala Harris went on TV and said that she would “fight for their rights.” This statement presumes that illegal aliens have a right to stay in the United States. DHS Secretary Alejandro Mayorkas actually said, “From day one, this Administration has made clear that a border wall is not the answer.” And certainly, no wall is needed if you do not wish to keep people out.

While the Biden White House and many of his appointees are misrepresenting reality, the intelligence agencies, Department of Defense (DoD), and Department of Homeland Security (DHS), apart from Mayorkas, are doing their duty by identifying the real threats. The Annual Threat Assessment of the United States Intelligence Community identifies the greatest national security threats as China, Russia, Iran, and North Korea. The term “white supremacy” is mentioned only once, on page 30. By contrast, the word China appears 91 times and has its own entry in the table of contents. White Supremacy is listed as one of many racially or ethnically motivated violent extremists (RMVE). The report does not say that it is a primary threat. In fact, it reports that, across the entire globe, only 27 people, most of whom were not American, were killed by RMVE since 2022.

The Department of Defense (DoD) National Defense Strategy Report similarly recognizes China and Russia as the two largest threats, followed by North Korea and Iran. The report does not mention white supremacy at all.

The Department of Homeland Security (DHS) recognizes terrorism, both foreign and domestic, as the primary threat. This includes radicalization by foreign entities and the rebuilding of al-Qa’ida and ISIS. After terrorism, DHS expects “illegal drugs produced in Mexico and sold in the United States will continue to kill more Americans than any other threat.” Last year, there was a record number of encounters with migrants at the southern border, including “a growing number of individuals in the Terrorist Screening Data Set (TSDS), also known as the ‘watchlist.'”

This brings us to the false claim that the border is secure.

Trump was attacked for allegedly saying that migrants are not human. What he was actually saying was that with open borders, we are allowing gang members to enter the country, and the gang members have committed such atrocities that they are not human. He was also attacked for saying that Mexico is not sending us their best and their brightest; they are sending us drug dealers and rapists. He did not claim that all migrants were criminals. He said that some were good people. But he was 100% correct in saying that some are gang members, drug dealers, and criminals.

The US permits about 770,000 immigrants to be naturalized each year, which is more than the rest of the world combined. By definition, those who do not qualify to be admitted legally are not the best and the brightest. Trump’s claims are not only supported by logic but also by the reports of U.S. authorities, including DHS, the Intelligence Community, local media along the border, and The Office of Justice Programs, among others.

FBI Director Wray confirmed that the border crisis is a national security threat. The DEA reported that “Fentanyl is the greatest threat facing Americans today.” Fentanyl is manufactured in Mexico by cartels, using chemicals from China. It is then smuggled over the border by illegal aliens and distributed through street gangs with ties to the cartel. Often, these gangs have members who are illegal aliens and have been trafficked to the United States to work in illicit businesses such as drug dealing, prostitution, and even murder.

The Annual Threat Assessment of the United States Intelligence Community states that Mexico-based Transnational Crime Organizations (TCOs) “are the dominant producers and suppliers of illicit drugs to the U.S. market, including fentanyl, heroin, methamphetamine, and South American-sourced cocaine.”

The Office of Justice Programs issued a report outlining the danger posed by cross-border gangs operating through the southern border. U.S. Immigration and Customs Enforcement wrote, “Transnational criminal street gangs such as MS-13 represent a significant threat to public safety.” A report by the Air Command and Staff College Air University stated, “Mexican Cartels along our Southern border pose a serious threat to our national safety and public health.” Furthermore, the report explained why the cartel threat is increasing: “As their influence and sophistication grow and the connection between them and terrorist organizations increases, the cartels become a larger threat to our national security.”

In conclusion, apart from Biden, neither the intelligence community, DEA, DHS, FBI, ICE, nor the DoD identified white supremacists as the greatest threat to national security. Additionally, no one other than Mayorkas claimed that the border was secure. By ignoring the reports of our intelligence and security agencies, the administration is increasing the threat to our national security.

Miranda Devine addresses “The Smirnov turnoff” in today’s New York Post column “New election year means another Russiagate as Biden, Dems try to smear impeachment probe.” Devine is of course the invaluable historian of The Laptop From Hell and the Biden family business. Here is the opening of her column:

For the 2016 election, Democrats launched Russiagate 1.0: the Trump-Russia collusion hoax proven groundless by the Mueller investigation.

For the 2020 election, it was Russiagate 2.0. Biden campaign adviser Antony Blinken prompted former CIA Acting Director Mike Morell to concoct the “Dirty 51” letter falsely claiming that Hunter Biden’s abandoned laptop was Russian disinformation.

That lie justified censorship of The Post’s accurate stories from the laptop of Joe Biden’s involvement in his son’s international influence peddling schemes.

Now that we’re heading into the 2024 election, we have Russiagate 3.0. Democrats pretend the impeachment inquiry has “utterly collapsed” because of the curious indictment last week of trusted FBI informant Alexander Smirnov on false statement charges after he allegedly told his FBI handler that Hunter and Joe each had received a $5 million bribe from the Ukrainians.

In a frantic effort to keep Smirnov in jail pre-trial, prosecutors for notorious Biden protector David Weiss, the Delaware US attorney, used language ripped straight out of the Russiagate textbook: “Smirnov’s efforts to spread misinformation about a candidate of one of the two major parties [Joe] continues.”

Now Smirnov is being used as make-believe vindication of the 51 former intelligence officials who signed the fake laptop letter to help Biden win the 2020 election.

Marc Polymeropoulos, a former CIA operations officer who claims to be a victim of the dubious “Havana syndrome,” pounced on the Smirnov story.

“It validates exactly what we were warning about,” he told NBC News. “The Russians were going to push this narrative of Hunter Biden and corruption, to hurt Joe Biden.”

No. Hunter’s “laptop from hell” was not Russian disinformation. It still isn’t. The FBI has had it in its possession since December 2019 and has authenticated it as real and valid for use in court.

The Dirty 51 are grasping at straws to try to justify their interference in the 2020 election. It wasn’t the Russians. It was Trump-deranged former CIA management who felt any means justified the ends if they could stop Trump winning a second term.

But now, as the laptop is augmented by whistleblower receipts and witness testimony, and as House Oversight Committee chairman James Comer unravels the complex web of corrupt foreign payments to the Biden family, the president’s praetorian guard is desperate. They are drowning in evidence of corruption while burbling, “There is no evidence!” Russia is all they have.

The joke is on Biden’s media handmaidens still pushing Joe Biden’s absurd lies.

No, the laptop is not a “Russian plant,” as he claimed. And, yes, Joe did talk to Hunter about his “overseas business dealings.”

Heck, he did a lot more than talk.

He made himself available for breakfasts, lunches, dinners, coffees, and pleasant chit chat on the speakerphone with Hunter’s foreign benefactors, all to oil the wheels of the family business — which was selling access to him, as he well knew.

“Look after my boy,” he told Kremlin-backed oligarch Elena Baturina and her husband, Yuri Luzhkov, the corrupt former mayor of Moscow, when Hunter activated the speakerphone at a Russian restaurant in Brooklyn called Romanoff on May 4, 2014.

They sure did. Just three months earlier, Baturina had wired $3.5 million to Rosemont Seneca Thornton LLC, the firm cofounded by Hunter, his “best friend in business” Devon Archer, John Kerry’s stepson Chris Heinz, and Jimmy Bulger, nephew of mobster “Whitey” Bulger.

As mentioned in a previous item, Philip Haney, author of See Something Say Nothing: A Homeland Security Officer Exposes the Government’s Submission to Jihad, had a sequel in the works, but turned up dead by gunshot in Amador County, California, in early 2020. Dr. Katherine Raven, who has performed more than 5000 forensic autopsies, signed off on a “homicide autopsy.”

Two years later, under a sheriff who graduated from the FBI academy, a deputy with no apparent medical training listed “apparent self-inflicted gunshot wound” as the cause of death.

The FBI held on to Haney’s computer, thumb drives, and “whistleblower documents.” The DHS accused Haney of harboring “contraband” and violating five federal laws. The signs point to a faked suicide, hardly a new tactic. As Sidney Hook recalled in Out of Step, Soviet defector Gen. Walter Krivitsky was “suicided” in a Washington hotel room by Stalin’s NKVD, forerunner to the KGB.

Danish diplomat Povl Bang-Jensen refused to reveal names of Hungarian patriots who testified to the UN about Soviet atrocities during the 1956 invasion. In 1959, after going missing for two days, Bang-Jensen was found dead in a New York park, shot through the right temple. The scene looked staged but the case was officially declared a suicide. In 1993, White House official Vincent Foster turned up dead in Fort Marcy Park. The death was ruled a suicide but the scene left plenty to ponder, especially as the Clinton White House senior staff behaved in highly suspicious ways after Foster’s death (removing—and likely destroying—files from his office, etc.) See The Strange Death of Vincent Foster, by Christopher Ruddy.

Communist assassins also killed by staging fake car accidents. That was the fate of Soviet actor Solomon Mikhoels, artistic director of the Moscow State Jewish Theater and chairman of the Jewish Anti-Fascist Committee during World War II. By this time, Stalin had revived traditional Russian anti-Semitism, branding Jews “rootless cosmpolitans.”

Nobel laureate Albert Camus, author of The Plague and other books, opposed the Soviet invasion of Hungary and was on record that Communism equals murder. In The Death of Camus, Giovanni Catelli compiles evidence that Camus was the victim of a fake car accident set up by the KGB. The ultimate trick, as Whittaker Chambers explained in Witness, was to make the assassination look like a natural death. That is a distinct possibility in several cases, to be explored at length in future.

The death of Philip Haney, meanwhile, shows what can happen to those who expose Islamic terrorists and their enablers in the US government. That raises issues for those who expose the FBI as the government’s secret police and KGB. When booting up a computer or tablet, see if “FBI Van,” or “FBI Surveillance Van,” show up in other networks in your neighborhood, then suddenly disappear.

Watch for persons unknown offering to send materials to your residence. Take note of strangers who suddenly engage you in conversation and just before leaving ask where you live. Apprise colleagues, friends and loved ones of these realities. Most important, never stop calling out those who attack the God-given freedoms of the people.

The Smirnov turnoff

We are apparently meant to take last week’s indictment of long-time FBI confidential human source Alexander Smirnov as a repudiation of what we have learned about the Biden family business. Smirnov’s indictment was sought by Biden-friendly United States Attorney David Weiss. It is linked in the related Department of Justice press release.

Kim Strassel observes in her weekly Wall Street Journal column: “If th[e allegations are] true, it ought to be massive story that the FBI for 13 years relied on a man who prosecutors now worry has troubling and ‘extensive’ ties to Russian intelligence. Instead, the media in its desire to embarrass Republicans is working to absolve the FBI, with the New York Times explaining the bureau never did ‘think much’ of the Smirnov claims and concluded in 2020 that they ‘did not merit continued investigation.’”

This particular episode of the Biden saga reminds me of the phonetically linked Yakov Smirnoff. Smirnoff is the immigrant comedian who wielded his catchphrase to great effect: What a country! Smirnoff’s catchphrase might qualify as the motto of the entire saga of the Biden family business. Looking around for a photo of Yakov Smirnoff I discovered that Jonathan Turley also drew on Smirnoff’s work in his New York Post column on the indictment.

Peter Schweizer first outlined the Biden family saga based entirely on publicly available documents in Profiles in Corruption (2020). In one of the interviews about the book, Peter observed: “We’re not talking about a congressman who’s trying to get a road paving for his nephew from the federal highway funds…We’re talking about globalized graft and corruption involving actors around the world who don’t particularly have the interests of the United States at heart.”

Yesterday Andrew McCarthy elaborated on “David Weiss’s Very Peculiar Smirnov Indictment in the Biden Case.” He commented: “[N]one of the most critical evidence of Biden-family influence-peddling comes from Smirnov or Russians.”

I sat down intending to demonstrate the irrelevance of the Smirnov indictment in light of the evidence accumulated to date, but Andy has done my job for me this morning in today’s NRO column “The Smirnov Indictment Does Not Vindicate the Bidens.” Subhead: “There is already extensive evidence, having nothing to do with Smirnov, of corrupt Biden-family influence-peddling.” If you can’t see the corruption, you’re not paying attention or you’re not looking. It’s in plain view. Miranda Devine also makes this point in her accessible New York Post column “Despite media spin, there’s still overwhelming evidence Joe Biden knew of family’s business dealings.”

I’m sorry McCarthy’s columns are posted behind NRO’s paywall. I wish some public-spirited benefactor would make a deal with NR’s publisher to extract McCarthy from NRO’s paywall prison. He brings his long experience as a federal prosecutor to bear and is the best columnist out there on matters at the intersection of law and politics.

The Wall Street Journal has posted Mark Kelly’s accessible video below in connection with the appearance of James Biden for deposition by the House Oversight and Judiciary Committees behind closed doors this week (Fox News story here). The caption on the video reads: “The latest revelations in the House Oversight Committee investigation into Biden family business dealings surrounds two checks that landed in Joe Biden’s personal bank account, one for $40,000, the other for $200,000.” As I say, if you can’t see it you’re not looking.
